1. Service purpose

CustomersWay is a SaaS (Software as a Service) platform focused on website monitoring and analysis from the end-user perspective.

The platform includes, among other features:

• Technical error monitoring.
• Broken link detection.
• SEO analysis.
• Web performance monitoring.
• Alert and report generation.
• Issue grouping and prioritization.

Available features may vary depending on the subscribed plan and service evolution.

2. Contracting process

Services are contracted electronically through the website.

The user states that:

• Has legal capacity to contract.
• Acts on their own behalf or with authorization from the represented company.
• The information provided during registration is truthful and up to date.

Once the contracting process is completed, the user will receive a confirmation email.

3. Trial period

CustomersWay may offer a limited free trial period.

Unless stated otherwise:

• The trial period lasts 10 calendar days.
• No payment data is requested during the trial period.
• Once the trial ends, access may be limited or disabled until a paid plan is contracted.
• The user may cancel or stop using the service at any time from the user panel.

The owner reserves the right to modify, limit, or remove promotions and trial periods.

4. Price and billing

Service prices are those shown on the website at any given time.

Unless otherwise stated:

• All prices are shown in euros (EUR).
• Applicable taxes (VAT or others) will be added according to current regulations.
• Billing is periodic and automatic while the subscription remains active.

The user authorizes recurring charges for the corresponding amount using the provided payment method.

5. Duration and cancellation

The subscription may be monthly or annual, depending on the plan selected during contracting.

Subscriptions renew automatically at the end of each billing period while an active payment method exists on the account.

The user may cancel automatic renewal at any time from the user panel.

Cancellation prevents future charges but does not imply refunds for amounts already paid for the current period.

Service access remains active until the end of the already paid period.

6. User obligations

The user agrees to:

• Use the platform in accordance with law and these terms.
• Not use the service for illegal or fraudulent activities.
• Not attempt to access restricted areas, internal systems, or platform vulnerabilities.
• Not interfere with normal service operation.

The user is responsible for safeguarding access credentials.

7. Service availability

CustomersWay will make reasonable efforts to maintain platform availability and proper operation.

However, service may be temporarily interrupted due to:

• Maintenance tasks.
• Updates.
• Technical incidents.
• Causes beyond the owners control.

Continuous and uninterrupted availability is not guaranteed.

8. Limitation of liability

The owner does not guarantee that the service is error-free or fully meets specific user expectations.

To the extent permitted by applicable law, the owner is not liable for:

• Indirect losses.
• Loss of profits.
• Loss of data.
• Business interruptions.
• Damages arising from use or inability to use the service.

The user acknowledges that platform analyses, recommendations, and metrics are informational and decision-support in nature.

9. Intellectual property

All rights related to the platform, software, design, source code, logos, documentation, and content belong to the owner or its licensors.

Contracting the service does not imply transfer of intellectual property rights to the user.

Copying, reproduction, distribution, or reverse engineering of the platform is prohibited unless expressly authorized.

10. Data protection

Personal data processing is carried out according to the Privacy Policy available on the website.

11. Modifications

The owner may modify these terms when necessary for legal, technical, or business reasons.

Relevant changes will be communicated to users through reasonable means.

12. Account suspension or cancellation

The owner may suspend or cancel user accounts in case of:

• Breach of these terms.
• Fraudulent use.
• Activities that compromise service security or stability.

13. Applicable law and jurisdiction

These terms are governed by Spanish law.

For any dispute arising from interpretation or execution of these terms, the parties submit to the courts determined by applicable law.
